do not pretend to know Indian Law, but it would appear to me that there
is no recourse to the expulsion from the tribe of all members who are
not deemed to be of 100% Tsalagi blood. The proposal passed is an amendment
to The Cherokee Constitution. It needs only to be certified by the election
commission and unless some voting irregularity can be found, it will
become a part of the constitution. If it is a part of the constitution,
it cannot be unconstitutional.The Cherokee Supreme Court can only rule
on the constitutionality of a case brought before it and therefore this
case can not apply to the court.
The proposed constitutional amendment was approved by Chief of The
Cherokee Nation, Chad," Corntassle" Smith who is a well known expert
on indian law and has been a professor at several prestigious universities.
It is most unlikely that there are any irregularities for the board of
elections to find. The Tsalagi it would seem, have been successfully
ethnically cleansed.
